Pre and Post-Nuptial Agreements Protect Your Estate

Pre-Nuptial or Post-Nuptial Agreements, are often misunderstood. They are construed as “romance killers” or as demonstrating a “lack of trust.”  The reality is that these agreements are often the best way for couples to achieve their financial and estate planning goals. 

A Pre-Nuptial Agreement is a written contract entered into between two individuals prior to their marriage. A Post-Nuptial Agreement is a written contract entreated into between two individuals after their marriage. While each Nuptial Agreement is unique, the agreement will generally include the following:

    • An inventory of what each spouse owns and is bringing into the marriage;

    • How community and separate property assets will be shared during the marriage;

    • How community assets will be divided in the event of a divorce;

    • Whether either spouse will be entitled to spousal support; and

    • What rights each spouse will have upon the death of the other.

Benefits of a Nuptial Agreement

The benefits of a solid Pre-Nuptial or Post-Nuptial Agreement cannot be underestimated.  Some of the more important benefits are:

    1. You can protect the inheritance of your children from a prior marriage/relationship;

    2. You can protect yourself from a potential predator if there is a disparity in wealth;

    3. You can protect business interests from claims in a divorce or upon your death;

    4. You can minimize or eliminate litigation in a divorce or probate case saving thousands in legal fees;

    5. You can protect your assets against claims of your spouse’s creditors (and vice versa) by clearly defining each spouse’s separate property.

    6. You can ensure that your estate plan works as planned and will not be subject to attack by your spouse or his/her family after your death.
